Mistake #1: Cutting a hedge between February and August

A sunny April Saturday. Electric trimmer plugged in. Privet looks scruffy. Ten minutes in, a wren bursts out of the middle of the hedge.

Why people do it

The hedge looks untidy after winter. The neighbour just cut theirs. Nobody mentioned the legality. None of those reasons hold up in court.

What it actually costs

Penalty under the Wildlife & Countryside Act 1981 is a fine of up to £5,000 per offence (per nest), six months' imprisonment, or both. A criminal record sticks. Most prosecutions follow neighbour or RSPB reports.

How to avoid it

Cut hedges between September and January. If you must cut between February and August, inspect every section by hand and by eye for nests first, and stop work immediately if one is found. RSPB guidance is the working standard professionals use.

Mistake #2: Scarifying the lawn in spring rather than autumn

Cost: £200-£800 lawn repair. The RHS recommends scarifying in September or October, when growth is slowing and recovery conditions are best. Heavy spring scarification rips out grass roots that are still establishing, leaving bare patches that weeds colonise within weeks.

What and why

People see moss in March, panic, and hire a scarifier from Wickes or B&Q. Within a fortnight the lawn looks worse than the moss did.

Mistake #3: Over-fertilising the lawn

Cost: £150-£500 reseed. "More feed equals greener grass" is the most expensive folk belief in British gardening. Follow the label rate on the bag, whether that's Westland, Miracle-Gro or Evergreen from B&Q, Wickes or Homebase. Never feed during drought. Water in within 24 hours.

Mistake #4: Pruning a tree under a Tree Preservation Order

Cost: up to £20,000 (Magistrates' Court), unlimited (Crown Court). Gov.uk guidance on Tree Preservation Orders confirms that pruning, lopping or felling a protected tree without consent is a criminal offence. In a Conservation Area, you must give the council six weeks' written notice under section 211 even if no TPO exists.

Mistake #5: Using glyphosate (Roundup) wrongly near edible crops

Cost: contaminated crop, possible HSE breach. Spray drift from glyphosate (Roundup, sold at B&Q and Homebase) onto vegetable beds breaches the Control of Substances Hazardous to Health Regulations 2002 (COSHH) if applied as a workplace activity, and ruins the harvest either way. Mistake #6: Mowing too short in summer drought

Cost: £200+ reseed. Short grass in heat dries the soil out fast, and roots die back. RHS guidance is to raise the mower blade to 40-50mm between June and August, and mow weekly rather than fortnightly so you take less off each pass.

Fix

Mistake #8: Burning garden waste in a Smoke Control Area

Cost: statutory nuisance fines. The Smoke Control Areas (England) Regulations 2014 and updated 2022 rules restrict what you can burn in designated zones, which cover most English cities and large towns. Councils can issue fixed penalty notices for repeated breaches and statutory nuisance abatement for smoke complaints.

Fix

Compost on site. Use the council green-waste bin (typically £25-£60 a year). If you genuinely must burn, check your postcode on the council's Smoke Control Area map first and burn only authorised fuels in an authorised appliance.

Mistake #9: Moving infected wood (ash dieback / OPM)

Cost: notifiable disease offence under the Plant Health (England) Order 2015. Ash dieback (Hymenoscyphus fraxineus) and Oak Processionary Moth (OPM) are notifiable. Moving suspected infected wood off site without notification can spread regulated pests, which is an offence under the order.

Fix

Don't move suspected infected wood. Report through the Forestry Commission TreeAlert service. Photograph leaves, bark and any frass. If a tree surgeon is involved, ask for their Arboricultural Association (ARB) credentials.

Mistake #10: Power-washing block paving without resealing

Fix

After jet washing, brush in fresh kiln-dried sand on a dry day, then seal with a recognised sealer such as Resiblock (around £60 at Wickes) per label coverage. One coat now beats three call-outs later.

Mistake #11: Hiring uninsured or non-trade-body gardeners

Cost: £200 broken window, £300-£800 neighbour's fence, no claim possible. A cheap hourly rate hides the real risk. If you've already made one of these mistakes

If you've cut a hedge in spring and found a nest after the fact, stop immediately, photograph the site, and contact the RSPB wildlife enquiries line for guidance.
